Terms of Service/Fee Agreement

STUDENT BEHAVIORAL SOLUTIONS, LLC

FEE AGREEMENT & TERMS OF SERVICE

1. PARTIES This Agreement is entered into between Student Behavioral Solutions, LLC (“Consultant”) and the purchasing client (“Client”).

2. NATURE OF SERVICES (IMPORTANT) Student Behavioral Solutions provides educational consulting and advocacy support related to IEPs, school-based services, and behavioral/academic planning.

  • Consultant is not acting as an attorney and does not provide legal representation or legal advice.
  • Services are strategic, consultative, and advisory in nature. Outcomes are influenced by multiple factors outside Consultant’s control, including school district decisions.

3. SERVICES INCLUDED

  • IEP Strategy Package: Comprehensive review of IEPs and evaluations; 60-minute strategy consultation; identification of gaps; customized action plan.
  • IEP Meeting Advocacy ($1,850): Includes the Strategy Package, plus attendance at one IEP meeting (up to 2 hours) and post-meeting recommendations.

4. SCOPE LIMITATIONS (CRITICAL)

  • Consultant does not guarantee specific outcomes or school district compliance.
  • Consultant will not communicate directly with school districts except as part of scheduled services or as expressly agreed in writing.
  • Services do NOT include: Legal representation, filing formal complaints/due process, or ongoing case management.

5. CLIENT RESPONSIBILITIES & DOCUMENT DEADLINES Client agrees to provide accurate information and maintain professional communication.

  • Lead Time: Client must submit all relevant documents at least five (5) business days prior to the scheduled session. Failure to provide documents in this timeframe may result in rescheduling.
  • Decision Making: Client is the legal decision-maker. Consultant provides recommendations only.

6. FEES & PAYMENT

  • All services are flat-fee and paid in advance.
  • Payment confirms acceptance of this Agreement.

7. ADDITIONAL TIME & HOURLY RATES

  • Advocacy package includes up to two (2) hours of meeting attendance.
  • Additional time is billed at $150/hour (billed in 15-minute increments) and is due upon receipt.
  • Consultant may pause services for any unpaid balances.

8. REFUND & CANCELLATION POLICY

  • Fees are non-refundable once services have been scheduled or performed.
  • 24-hour notice is required for cancellation. One reschedule may be granted at Consultant’s discretion.
  • Missed appointments or late cancellations result in forfeiture of the fee.

9. TRAVEL Travel within Atlantic, Burlington, Camden, Cape May, Gloucester, Mercer, Middlesex, and Ocean counties is included. Travel outside this area may incur additional fees, disclosed in advance.

10. COMMUNICATION BOUNDARIES

  • Communication is limited to scheduled sessions and agreed-upon services.
  • Hours: Monday–Friday, 9:00 AM – 5:00 PM EST.
  • Consultant does not provide text-based consulting or crisis intervention services.

11. NO GUARANTEES Consultant does not guarantee specific outcomes, including changes to an IEP or specific school district decisions.

12. MEETING CHANGES & SCHOOL CANCELLATIONS Consultant will attempt to accommodate reschedules due to school-initiated changes, but availability is not guaranteed.

13. INTELLECTUAL PROPERTY & RECORDING All materials provided are for personal use only. Recording of sessions or meetings is prohibited without express written consent.

14. PROFESSIONAL CONDUCT Abusive, disrespectful, or unprofessional behavior toward the Consultant may result in immediate termination of services without refund.

15. LIMITATION OF LIABILITY To the fullest extent permitted by law, Consultant’s liability is limited to the amount paid for the specific service. Consultant is not responsible for school district decisions or actions.

16. DISPUTE RESOLUTION & GOVERNING LAW Any disputes arising from this Agreement shall be resolved through binding arbitration in the State of New Jersey. This Agreement shall be governed by the laws of the State of New Jersey.

17. ACCEPTANCE OF TERMS By purchasing services, Client acknowledges they have read, understood, and agreed to all terms and conditions.
